In April, the Florida Supreme Court ruled that it would not block a ballot initiative to legalize adult-use cannabis, leaving it up to voters to decide in November if they’ll approve a regulated legal cannabis market for the Sunshine State.

But what will Florida’s legalization initiative allow and what would it mean for the cannabis industry if the country’s fourth-largest state approves adult-use legalization?

If Florida voters approve cannabis legalization this November it would mean that half of all U.S. states have legalized - including the country’s fourth-largest state. 

But for Florida to legalize, Amendment 3 must receive at least 60% of the vote - by no means a foregone conclusion.

Florida already has a thriving medical cannabis market, one of the country's fastest-growing populations, and is a major center for tourism. The prospect of a thriving regulated cannabis market in the state is reason for excitement and optimism for many in the industry.

But what will it take for legalization in Florida to become a reality, and what will the regulated market look like if and when legalization goes into effect?

Sally Kent Peebles - Florida-based Partner | Vicente LLP

Sally Kent Peebles is a partner at Vicente LLP, where she helps cannabis businesses navigate the patchwork of state laws controlling marijuana through her corporate law, commercial real estate, licensing, and regulatory expertise. Based in Jacksonville, Sally is a leading voice on cannabis in Florida and the South and is a passionate advocate for drug policy reform. She was previously a leading member of the Florida Department of Agriculture and Consumer Services' Medical Cannabis Advisory Committee and co-founded the nonprofit organization WISE Florida in 2021, which advocates for legalizing cannabis for adult use in Florida.

Lauren Niehaus - Executive Director, Government Relations | Trulieve

Lauren Niehaus is the Executive Director of Government Relations efforts for Trulieve, the biggest supporter of the cannabis legalization campaign in Florida. At Trulieve, she fosters and maintains relationships with key regulators and elected officials in local, state, and federal governments. She also monitors, analyzes and lobbies local, state, and federal regulatory and legislative agencies, and provides analysis and insight on ballot initiatives and industry social trends.
